Connexeon BV, trading under the name Wizzou, with registered office at Emiel Banningstraat 47 / 5, 2000 Antwerp, Belgium and registered with the Crossroads Bank for Enterprises under number 0867.496.536, is responsible for the processing of personal data as described in this Privacy Policy where Wizzou acts as data controller.

In this Privacy Policy, "Wizzou", "we", "us" and "our" refer to Connexeon BV trading as Wizzou.

2. SCOPE OF THIS PRIVACY POLICY

This Privacy Policy explains how Wizzou collects, uses, shares, protects and retains personal data in connection with websites, portals, forms, communications and services operated under the wizzou.com domain, as well as our general business relationship with customers, prospects, suppliers, partners, applicants and other contacts.

This includes, where applicable, our website, customer and support interactions, project enquiries, hosting and infrastructure services, consulting, software development, digital marketing and other Wizzou services.

Products or services operated under separate brands, including Ominity and Onetagger, may have their own privacy policies. Where a separate privacy policy applies to such a product or service, that policy takes precedence for processing specifically related to that product or service.

This Privacy Policy does not necessarily apply to third-party websites, platforms or services that may be linked from Wizzou websites. Those third parties process personal data according to their own privacy policies.

3. OUR ROLE UNDER DATA PROTECTION LAW

Depending on the circumstances, Wizzou may process personal data either as a data controller or as a data processor.

Wizzou generally acts as data controller when it determines why and how personal data is processed, for example when:

  • you visit our website;
  • you contact us;
  • you request a quotation or consultation;
  • you become a customer;
  • we manage billing and accounting;
  • we send permitted marketing communications;
  • you apply for a job or other position;
  • we operate our own security, analytics and administrative systems.

Wizzou may act as a data processor where we process personal data solely on behalf of a customer, for example where customer applications, websites, databases, backups or infrastructure hosted or managed by Wizzou contain personal data controlled by that customer.

Where Wizzou acts as processor, the relevant customer is normally responsible for determining the purposes and lawful basis of the processing and for providing appropriate privacy information to the affected individuals. Processing by Wizzou will be governed by the applicable agreement and, where required, a data processing agreement.

The personal data we process depends on how you interact with Wizzou.

  • Contact data, such as your email address, telephone number, postal address and company contact information;

The legal basis is generally taking steps at your request before entering into a contract and, where applicable, Wizzou's legitimate interest in managing business enquiries and developing commercial relationships.

We process personal data where necessary to create and manage customer relationships and provide contracted Services.

  • contract and quotation management;

We process personal and business contact information for invoicing, payment processing, accounting, financial administration, debt recovery and compliance with tax and accounting obligations.

This may involve information such as names, company details, addresses, VAT numbers, invoices, transaction references and payment status.

The legal basis is generally the performance of a contract, compliance with legal obligations and Wizzou's legitimate interest in administering and recovering amounts due.

10. SUPPORT AND CUSTOMER COMMUNICATIONS

When you contact Wizzou for technical or customer support, we process the information necessary to investigate and resolve your request.

Where appropriate, publication will be based on consent, contractual arrangements or our legitimate interest in documenting and promoting our work, taking into account the reasonable expectations and rights of the individuals concerned.

Non-public personal or confidential information will not intentionally be published merely for marketing purposes without an appropriate legal basis.

19. SERVICE PROVIDERS AND PROCESSORS

  • Microsoft 365 and related Microsoft services for email, collaboration and productivity;
  • Mollie and other payment service providers for payment processing;
  • Yuki and other accounting or financial administration providers;
  • Zendesk and other customer support or ticketing platforms;
  • Odoo and other customer relationship management, administration or business software providers;
  • Cloudflare and other network, security, DNS, CDN or infrastructure providers;
  • hosting, cloud, storage and data-centre providers;
  • analytics and measurement providers;
  • advertising platforms;
  • email and communications providers;
  • professional advisers such as accountants, auditors and legal advisers;
  • suppliers, subcontractors and technical partners involved in providing our Services.

The specific providers used may change over time as our services and technical infrastructure evolve.

Wizzou aims to select providers that offer appropriate data protection and security safeguards in relation to the processing they perform.

20. SHARING OF PERSONAL DATA

We do not sell personal data as a standalone commercial product.

We may disclose personal data where reasonably necessary to:

  • provide or support our Services;
  • process payments and accounting;
  • operate our websites and infrastructure;
  • perform analytics or advertising activities based on applicable legal requirements and consent choices;
  • work with professional advisers and suppliers;

Some service providers used by Wizzou may process personal data outside Belgium or outside the European Economic Area.

Where personal data is transferred outside the European Economic Area and the recipient country has not been recognised as providing an adequate level of protection, Wizzou will rely on an appropriate transfer mechanism where required by law.

Such mechanisms may include European Commission Standard Contractual Clauses, an applicable adequacy decision, the EU-U.S. Data Privacy Framework where applicable, or another lawful transfer mechanism.

Additional organisational or technical safeguards may be used where appropriate in light of the relevant processing and transfer risk.

22. DATA LOCATION AND INFRASTRUCTURE

Wizzou may process and store personal data using infrastructure operated directly by Wizzou as well as infrastructure or services supplied by third parties.

The technical location used for a particular service may depend on operational, security, availability, contractual and technical requirements.

Where an Agreement or data processing agreement contains specific data-location commitments, those commitments take precedence for the relevant Service.

23. DATA RETENTION

Wizzou retains personal data only for as long as reasonably necessary for the purposes for which it was collected and for any applicable legal, contractual, accounting, security or dispute-resolution requirements.

Retention periods vary depending on the nature of the data and processing purpose.

For example:

  • customer and contractual information may be retained during the customer relationship and afterwards where necessary for legal, accounting or dispute-resolution purposes;
  • accounting and invoicing information is retained for the period required by applicable Belgian accounting and tax legislation;
  • business enquiries may be retained for a reasonable period to manage follow-up and future business opportunities;
  • support records may be retained where useful for service history, troubleshooting, security and contractual purposes;
  • technical and security logs are generally retained for a limited period appropriate to their operational or security purpose, unless longer retention is required for an incident or legal claim;
  • marketing information may be retained until consent is withdrawn, an objection is made or the information is otherwise no longer required, subject to retention of suppression records where necessary;
  • recruitment information is retained only for the recruitment process and a reasonable period afterwards unless a longer period is justified or agreed.

Data may be retained for longer where necessary to comply with legal obligations, preserve evidence, investigate abuse, resolve disputes or establish, exercise or defend legal claims.

24. DATA SECURITY

Wizzou uses technical and organisational measures intended to protect personal data against unauthorised access, alteration, disclosure, accidental loss and unlawful processing.

Depending on the relevant system and risk, these measures may include access controls, authentication mechanisms, encryption, network security, logging, monitoring, backup procedures, infrastructure isolation and organisational access restrictions.

Access to personal data is limited to persons and service providers who reasonably require access for their role or the provision of the relevant Service.

No information system or method of electronic transmission can be guaranteed to be completely secure. Wizzou therefore cannot guarantee absolute security.

25. PERSONAL DATA BREACHES

Where Wizzou becomes aware of a personal data breach for which it acts as controller, Wizzou will assess the incident and take appropriate steps in accordance with applicable data protection law.

Where notification to the competent supervisory authority or affected individuals is legally required, Wizzou will make the required notification within the applicable legal framework.

Where Wizzou acts as processor, Wizzou will inform the relevant controller of a qualifying personal data breach in accordance with the applicable data processing agreement and legal requirements.

26. YOUR DATA PROTECTION RIGHTS

Subject to the conditions and limitations provided by applicable law, you may have the right to:

  • obtain information about the processing of your personal data;
  • request access to your personal data;
  • request correction of inaccurate or incomplete personal data;
  • request deletion of personal data;
  • request restriction of processing;
  • object to processing based on legitimate interests;
  • object to direct marketing at any time;
  • request portability of certain personal data;
  • withdraw consent at any time where processing is based on consent;
  • lodge a complaint with a competent supervisory authority.

Withdrawal of consent does not affect the lawfulness of processing carried out before the consent was withdrawn.

Some rights are not absolute and may not apply where Wizzou has a legal obligation or other lawful reason to continue processing particular information.

If you believe Wizzou has processed your personal data in violation of applicable data protection law, you have the right to lodge a complaint with the competent supervisory authority.

29. AUTOMATED DECISION-MAKING

Wizzou does not currently use personal data collected through the Wizzou website or ordinary Wizzou business relationship to make decisions based solely on automated processing that produce legal effects or similarly significant effects concerning individuals.

If this changes, Wizzou will provide the information and safeguards required by applicable law.

30. SPECIAL CATEGORIES OF PERSONAL DATA

Wizzou does not intentionally request or require special categories of personal data, such as health information, biometric data, religious beliefs, political opinions or information concerning a person's sex life, as part of ordinary interactions through the Wizzou website or normal customer relationships.

Please avoid providing such information unless it is genuinely necessary for a specific purpose and an appropriate lawful basis exists.

If special-category information is provided to us incidentally, we will handle it in accordance with applicable data protection requirements.

31. CHILDREN

Wizzou's websites and services are primarily intended for businesses and professionals and are not directed at children.

We do not knowingly seek to collect personal data from children through our general website or ordinary business services.
